Welcome to ThePropBook. These Terms and Conditions ("Terms") govern your access to and use of our property portal platform. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our platform.

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Indian Contract Act, 1872, and other applicable Indian laws. Any disputes shall be subject to the exclusive jurisdiction of courts in Gurugram, Haryana, India.

1. Acceptance of Terms

By registering, accessing, or using ThePropBook, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

    You must be at least 18 years old to use our platform

  • Legal capacity

    You must have the legal capacity to enter into binding contracts

  • Compliance

    You must comply with all applicable Indian laws and regulations

  • Account accuracy

    You must provide accurate, current, and complete information during registration

3. User Accounts
3.1 Account Creation

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
3.2 Account Types
  • Buyers

    Can search, view, and inquire about properties

  • Brokers

    Can list properties, manage leads, and access broker tools

  • Builders

    Can list projects, manage inventory, and track leads

  • Administrators

    Platform administrators with full access

4. Property Listings
4.1 Listing Requirements

When listing a property, you agree that:

  • Accurate information

    All property details, images, and documents are accurate and current

  • Legal ownership

    You have the legal right to list and sell/rent the property

  • Compliance

    The property complies with all applicable building codes, zoning laws, and regulations

  • No misrepresentation

    You will not misrepresent property features, location, or legal status

4.2 Prohibited Listings

You may not list properties that:

  • Are involved in illegal activities
  • Violate any Indian laws or regulations
  • Infringe on intellectual property rights
  • Contain false, misleading, or fraudulent information
  • Are subject to legal disputes or encumbrances
5. Fees and Payments
5.1 Service Fees

Certain services may be subject to fees, including but not limited to:

  • Listing fees

    Charges for premium property listings

  • Lead subscription fees

    Monthly or annual subscriptions for lead access

  • Transaction fees

    Commission on successful property transactions

5.2 Payment Terms
  • Payment methods

    We accept payments through secure payment gateways (UPI, credit/debit cards, net banking)

  • GST

    All fees are inclusive of applicable GST as per Indian tax laws

  • Refunds

    Refunds (if applicable) are handled as per the plan terms shown at purchase and applicable laws

6. User Conduct

You agree not to:

  • Violate any applicable Indian laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious code, viruses, or harmful software
  • Harass, abuse, or harm other users
  • Spam or send unsolicited communications
  • Impersonate any person or entity
  • Interfere with platform operations or security
7. Intellectual Property

All content on ThePropBook, including text, graphics, logos, software, and design, is owned by ThePropBook or its licensors and is protected by Indian copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

By uploading content to our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for platform operations.

8. Disclaimers and Limitation of Liability
8.1 Platform Disclaimer

ThePropBook is provided "as is" without warranties of any kind. We do not guarantee:

  • The accuracy, completeness, or reliability of property listings
  • That properties are available, legal, or suitable for your needs
  • Uninterrupted or error-free platform operation
8.2 Limitation of Liability

To the maximum extent permitted by Indian law, ThePropBook shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold ThePropBook, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Inaccurate or fraudulent property listings
10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Any reason we deem necessary to protect platform integrity

You may terminate your account at any time by contacting us. Upon termination, your right to use the platform will immediately cease.

11. Dispute Resolution
11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Gurugram, Haryana, India.

11.2 Arbitration

In case of disputes, parties agree to first attempt resolution through good faith negotiation. If unsuccessful, disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 2015, by a sole arbitrator appointed by mutual agreement.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or platform notification. Your continued use after such changes constitutes acceptance of the modified Terms.
